The Georgian Law on Design Has Been Amended

The amendments to the Design Law of Georgia have entered into force, introducing several changes that bring the legislation closer to EU design legislation and address existing gaps.

The amendments clarify matters related to the disclosure of information on a design, grounds for refusal of design registration, the filing of an international application through the Georgian IP Office (Sakpatenti), the designer’s right to be named, the invalidation of a design registration, the possibility of maintaining a design in a modified form, and the retroactive effect of invalidation. Importantly, a re-examination procedure has also been introduced. Moreover, the competence of the Chamber of Appeals has been expanded.

Corresponding changes will follow in the Governmental Decree on fees, in the Instruction on Design Registration and in the Statute of the Chamber of Appeals at Sakpatenti.
